Swiss Federal Court Allows Afghan Deportations in Certain Cases

DID Press: Switzerland’s Federal Administrative Court has ruled that the deportation of Afghan asylum seekers can be permissible when “favorable individual circumstances” exist.

The ruling followed the rejection of an asylum application by an Afghan national. Judges in St. Gallen, after reassessing conditions in Afghanistan, said returns should remain limited but could be permitted in certain cases depending on an individual’s circumstances.

The court’s ruling applies to all regions of Afghanistan.

In the case under review, the applicant was described as a young, healthy Pashtun man with previous employment experience and access to a family support network in Kabul.

Switzerland’s migration authorities rejected his asylum application at the end of 2025 and ordered his deportation. The court subsequently upheld the decision, finding that his individual circumstances could allow for his return to Afghanistan.

The ruling comes amid growing debate across Europe over whether Afghan nationals can safely be returned to Afghanistan under Taliban rule.
